Am I Eligible for VRS Disability Benefits?

You are eligible for disability retirement through the Virginia Retirement System if you have a long-lasting medical condition that prevents you from doing your job and you are a:

State employee hired prior to January 1, 1999 who did not chose to transfer to the Virginia Sickness and Disability Program (VSDP); or,
An employee of a school division or VRS-participating political subdivision employee in VRS Plan 1 or VRS Plan 2.

How Does the VRS Define Disability?

The Virginia Retirement System considers a disability to be:

The result of an injury, illness, or cognitive condition. A cognitive condition is a disability if it leads to a loss or deterioration in intellectual capabilities.
Work-related or non-work related. A work-related disability is an occupational disease or injury that is covered under the Virginia Workers’ Compensation Act.
A chronic condition that worsens to the point that you are unable to continue performing your job duties.

Those of you who were disabled before taking a covered position must experience significant worsening in your condition to be considered for disability retirement through the Virginia Retirement System.

When Can I Apply for Disability Retirement through the VRS?

VRS disability retirement provides no minimum age or service requirements. You can apply from the first day of your employment through 90 days after your last day of employment. Other time limitations may apply depending on your circumstances.

Should I Pursue Disability Retirement through the VRS?

Financially, it may be to your advantage to retire under service retirement instead of disability retirement if you are eligible for service retirement under Plan 1 or Plan 2.
